OSCARwash general terms and conditions.

Vehicles are cleaned in the automatic car wash on the basis of the following general terms and conditions.

The user instructions / operating instructions / entry instructions must be observed, along with any instructions given by the operator or personnel.

The automatic car wash operator guarantees that vehicles will be cleaned in a proper and gentle manner in accordance with state-of-the-art automatic car wash technology. The user must assert any claims for rectification of defects due to insufficient cleaning immediately on leaving the car wash.

The car wash personnel must refuse all vehicles which could cause damage by using the automatic car wash, due to special circumstances that are obvious to the personnel.

The customer/driver is obliged to notify us, in a timely manner before the car wash commences, of any circumstances of which he is aware which could lead to damage to the vehicle or the car wash.

The automatic car wash operator shall be liable to the user for compensation for any damage caused by circumstances which could have been avoided had he applied the necessary care.

In case of damage caused by the washing process in the automatic car wash, the car wash operator is liable for the direct damage. Consequential losses will not be compensated, unless the car wash operator is liable for gross negligence.

The system operator shall not be held liable in particular if damage has been caused by improperly attached vehicle parts or parts which are not part of the standard fittings for the vehicle (e.g. trim strips, mirrors, aerials, windshield wipers and rods, bumpers, fuel/gas tank caps, spoilers, sunroof wind deflectors, headlight wiping system), or for damage to paintwork and scratches thereby caused. Unless the car wash operator or its staff are guilty of gross negligence or intent, or the violation of essential contractual obligations in general.

Liability is also excluded for damage caused by not observing entry and usage instructions which are clearly indicated and unambiguous, unless the car wash operator is liable for gross negligence.

The customer/vehicle driver must notify the car wash operator or staff of any claims for compensation for obvious damage before leaving the premises.

Excluded from liability are:

  • Tires and rims with a width in excess of 30 cm.
  • Tires and rims with a height below 4.5 cm.
  • Rims with a protruding rim edge (rims wider than the tires).
  • Vehicles with wheel spacers on the rear axle.
  • Vintage cars more than 30 years old.
  • Vehicles with parts not fitted as standard.

If these exclusions of liability are not observed, the car will be washed at the customer’s own risk. Car washing is carried out based on the legal regulations and the published "general terms and conditions".

Should a clause of these general terms and conditions or a part thereof be or become invalid, the validity of the remaining provisions shall remain unaffected.
